After two months of debate and discussion on Miami County’s community growth areas, the Miami County Planning Commission unanimously approved a recommendation on how the County Commissioners should proceed.

Six ideas were initially brought forward, which were condensed into three points the planning commissioners accepted as their recommendation.

They suggest that the county commission should eliminate community growth areas (CGA) because of a lack of city-level representation of individuals in the areas, which encompass all the land within three miles of every direction for the cities of Paola and Osawatomie.

In lieu of the CGAs, the planning commission recommended the implementation of joint planning areas. The county would have complete jurisdiction in the new areas, instead of allowing cities to control land use and subdivisions. The new area would require the formation of a new board of commissioners. The joint planning commission would have representation from the city, joint planning areas and the county. Their recommendations would be for the county commission. The concept of the designated areas gives the city officials an idea of where their growth is and what they’ll be annexing in the future.

The sale of fireworks in unincorporated Miami County moved one step closer to becoming a reality Wednesday morning at the Miami County Commission’s work session, which precedes the weekly meetings.

A resolution to allow sales will be placed on the agenda for the commission’s consideration at 1 p.m. next Wednesday in commission chambers at the Miami County Administration Building. The sale of fireworks would have to be on commercially zoned property outside any city growth area.

During their regular meeting, the county commissioners on Wednesday:

Approved an agreement between Miami County and BHC Rhodes for engineering design and surveying services for an intersection safety project at 287th Street and Old Kansas City Road. The project will create a cul-de-sac on Hospital Drive where it meets Old Kansas City Road and install actuated warning lights at 287th Street and Old KC Road to compensate for intersection sight distance. The design and surveying services will cost about $44,000.

Approved a resolution to authorize the transfer of 2009 Fire District No. 1 maintenance funds to the Fire District No. 1 equipment fund.
Approved authorization to solicit bids for a rubber-tired roller. For cost-saving reasons, county staff members will consider used equipment.
Authorized the commission chairman to sign a letter to the state of Kansas involving Medicare payments.

The Miami County Commission approved a resolution to place a quarter-cent sales tax program on the August ballot Wednesday afternoon. The tax is not an increase, but a continuation of a tax supporting the road and bridge fund that has replaced more than a dozen bridges, including the Bull Creek bridge, that otherwise would have been left in disrepair because of a lack of funds. The commission cannot approve the tax itself, which is why the final vote will come from Miami County residents in August.

In other business at Wednesday’s meeting, the commissioners:

Approved a design supplemental agreement No. 2 between Miami County and BG Consultants for a Osawatomie Road bridge replacement project.
Accepted the plat dedications for road and utility purposes for the Final Plat of Frosty Meadows subdivision.

Following the regular agenda items, the commissioners discussed problems with the growth areas surrounding Paola and Osawatomie. The controversial areas give cities authority over a certain area near the city limits, though it’s still considered county territory.  Commissioners agreed the problem lies in the lack of representation individuals have in the growth area at the city level.

“I have trouble getting past this,” Commissioner Ron Stiles said. He added that it’s not right for those in the growth area to have to deal with the cities’ codes and zoning regulations. “It’s not red, white and blue. It’s time to stop dancing around these growth areas.”

The heat wave hasn’t hit Kansas yet, but Miami County Commissioners have already started to discuss how fireworks are sold within Miami County.

Charlene Weiss, director of environmental health, spoke to commissioners at a work session Wednesday morning concerning the types of facilities fireworks could be sold from.

Discussion mainly revolved around regulations for different building structures, such as temporary, which are those with no foundation, versus permanent buildings and tents and how the county wants each city to enforce the selling of fireworks in certain city areas.

An interlocal agreement with Johnson County for bridge construction was approved unanimously by the Miami County Commission on Wednesday afternoon.
The bridge is on the border shared by the counties on 215th Street, about 0.2 miles west of Pflumm Road.

County Engineer Penny Evans said that the agreement originally was aimed at sharing the cost of a contractor for the bridge’s replacement, which would have cost hundreds of thousands of dollars. She recommended to Johnson County instead that Miami County crews could do all the construction work if Johnson County paid for materials.
The commissioners thanked Evans for her creative solution.

In other business, the commission on Wednesday:

Approved a resolution placing temporary stop signs at the intersection of 351st Street and Winchester Road. This is an effort to make it safer for redirected traffic that normally would travel on John Brown Highway where it meets Pressonville Road, an area that is under reconstruction.
Received an update on noxious-weed eradication and approved a county noxious-weed management plan.
Appointed Maurice Ball as Noxious Weed Department director for 2010.
