A rural Osawatomie man was arrested April 29 by Miami County sheriff’s deputies and accused of child abuse.

Assistant Miami County Attorney Elizabeth Sweeney-Reeder filed a formal felony charge May 1 against Jacob Bernard Cody, 35, of 37155 W. 351st St., alleging  willful, felonious and intentional torture, cruel beating or shaking of a child, or inflicting cruel and inhumane corporal punishment.

The alleged victim, identified only with initials in the court record, was born in 1998.

The defendant posted a $25,000 bond May 8 and is subject to the conditions of an order of protection issued when the bond was set May 1. Cody was ordered to have no contact with the alleged victim and was required to obtain an anger-control evaluation and return it to Miami County District Court. He also must not possess or have access to any firearms or ammunition, and he has been directed to abstain from using alcohol or drugs unless prescribed by a physician.

A no-go preliminary hearing has been scheduled for 10:30 a.m. Thursday.

An order of protection had been issued against Cody once before, in February 2007, for his wife, Christine T. Cody.
